26 Pushups is a fitness tracking mobile application designed to help users track their push-up exercises, set fitness goals, and monitor their progress over time. The App provides workout tracking features, progress analytics, and personalized fitness recommendations to support your health and wellness journey.
To access certain features of the App, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You must be at least 13 years old to use the App. You are responsible for ensuring that your use of the App complies with all applicable laws and regulations.
26 Pushups offers auto-renewable subscription options to access premium features. By purchasing a subscription, you agree to the following terms:
Subscriptions are managed through your Apple ID account and are subject to Apple's Terms of Service.
26 Pushups offers multiple subscription options to suit your needs:
Current pricing is displayed in the App and is subject to change. You will be notified of any price changes before they take effect. Price changes will not affect existing subscribers during their current subscription period.
You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation will take effect at the end of your current billing period. For refund requests, please refer to Apple's refund policies and procedures. To request a refund, visit https://reportaproblem.apple.com or contact Apple Support. We do not have the ability to issue refunds for purchases made through the Apple App Store, as all payments are processed through your Apple ID account.
All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the exclusive property of 26 Pushups or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App without our prior written consent.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 26 PUSHUPS, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (1) YOUR USE OR INABILITY TO USE THE APP; (2) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (3) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP; (4) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE APP BY ANY THIRD PARTY; OR (5) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE APP.
The App is intended for fitness tracking and motivational purposes only and should not be considered a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or fitness program. Never disregard professional medical advice or delay in seeking it because of something you have read or accessed through the App.
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, and limitations of liability.
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date below. You are advised to review these Terms periodically for any changes. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 26 Pushups operates, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
